Critical Legal Distinction Regarding "Legal Separation":
Delaware law does not recognize a formal court filing or lawsuit called "Legal Separation." You cannot file a court motion simply to become separated. Instead, the date of separation is an essential evidentiary cutoff date that stops the accumulation of marital property and marital debt, and starts the clock for divorce grounds.
Equitable Distribution of Marital Assets & Debts
Delaware is not a rigid 50/50 community property state. Under 13 Del. C. § 1513, Family Court judges apply equitable principles to divide marital property acquired between the date of marriage and date of separation:
- The duration of the marriage and prior marriages of each party.
- The age, health, station, amount, and sources of income, vocational skills, employability, and liabilities of each party.
- The contribution or dissipation of each party in the acquisition, preservation, or appreciation of marital property, including non-monetary homemaker contributions.
- Tax consequences and associated secured debts tied to specific property.
Statutory Penalty for Concealing Assets:
Delaware Family Court maintains a strict zero-tolerance policy regarding hidden assets. If a spouse intentionally conceals bank accounts, secret transfers, cryptocurrency, or business revenue, Delaware judges possess the statutory authority to award 100% of that hidden asset entirely to the other spouse as an equitable fraud sanction.
Pension & Retirement Division: The Cooper Formula
Retirement assets (state pensions, corporate defined benefit plans, 401(k) plans, 403(b) annuities) often represent the largest marital asset after real estate. In Delaware, retirement benefits are divided from the date of marriage to the date of divorce using the judicial Cooper Formula:
Marital Pension Share = (Months Married During Plan Employment ÷ Total Months of Creditable Service) × 50%

- The 8-Year Rule: Under 11 U.S.C. § 727(a)(8), a debtor cannot receive another Chapter 7 discharge within eight years of a previous Chapter 7 filing date.
